Rajesh Hirani (name changed) finally won his long-drawn battle against a public sector insurance company, thanks to IRDA, the watchdog handling insurance related affairs in India. It is not end of the world when your auto insurance company rejects your claim plea, you can always take the matter to IRDA!
Rajesh Hirani’s Maruti car was stolen. He had installed a CNG kit in the car, and was paying a separate insurance premium of Rs 1,544 per annum for this CNG kit. He filed an insurance claim after his car was stolen.
His insurance company made the payment for his lost car, but denied his claim for CNG kit saying that the car’s certificate of registration does not mention anything about the CNG kit.
Rajesh visited his insurance company’s office and spoke to several representatives; he even spoke to the insurance company’s zonal manager.
Hirani spent more than eight days meeting various officials from his insurance company, but it proved to be waste of time, as he did not get proper resolution from anyone. During those days, he watched a television commercial about the Consumer Dispute Redressal Forum (CDRF). It is a body which deals with consumer complaints against public sector and private companies.
Finally Rajesh decided to file a complaint with CDRF against his insurance company for not paying the claim amount for the CNG kit. But, he was disappointed once again as he was told that it will be better if he appoints a lawyer to represent his case. Forum’s reps also told him that he might have to wait for two to three years to get justice with help from CDRF.
Fortunately, while sharing his CDRF related experience with office colleagues, one of them advised Rajesh to register a complaint with IRDA- the Insurance Regulatory and Development Authority.
He visited their website and registered his complaint. IRDA officials contacted Rajesh and his insurance company within the next few days. The IRDA pointed out that the insurance company was charging Rs 1,544 as an insurance premium per year for the CNG kit in the car and the insurance company’s representative had verified the CNG kit in Hirani’s car before the issuance of the policy. The IRDA asked the insurance company to pay the claim amount of Rs 75,000 to Rajesh.
Finally, Rajesh got his claim amount from the insurance company.
